Terms and conditions

 

Epi Studios, located at 1-9 Solent CCT, Norwest NSW 2153, is owned and operated by Hillsong Church Australia Ltd atf Hillsong Church Australia (“Epi Studios”). The authorised recipient of the Booking Confirmation acknowledges acceptance of the following Epi Studios Pty Ltd Terms and Conditions of trading by the Client:

 

Studio Facilities:

We shall ensure, to the best of our ability, due care and diligence that the studio premises contain suitable equipment to complete the audio service as per the client’s instructions and therefore able to complete the audio service that the client has requested. During the use of the studio facilities, the client agrees to the following:

1.1 The studio will only be used for the agreed audio service, and as such, only those directly engaged in the audio service booked are permitted. We reserve the right to request that any persons not associated with the booking leave the studio premises.

1.2 The client, client’s staff and personnel, including those persons invited by the client, agrees that any equipment or digital media required to complete the session, that the client brings to the studio, is working properly for its purpose and agrees to take full responsibility for any damage caused by using the client’s equipment.

1.3 The client, client’s staff and personnel, including those persons invited by the client, agrees to take responsibility for any damage to media devices such as external hard drives, USB drives, or others, owned by the client, which are brought to the studio premises and cause damage to the studio’s computer equipment.

1.4 The client, client’s staff and personnel, including those persons invited by the client, agree to abide by the Studio’s rules and in relation to basic good health and safety practices in terms of Sound Level, non-smoking, no-vaping, no-alcohol policy at the studio.

1.5 Illegal substances are strictly prohibited, and any use or appearance will report to the competent authorities immediately.

1.6 We retain the right to charge the Client a cleaning and damage fee in the event of any damage to the studio, equipment, infrastructure, or facility, which includes, but is not limited to, spills, water damage, mistreatment of equipment or any accidental damage. This charge also pertains to smoking of any kind, as it is prohibited throughout the entire facility and studios.

 

Studio Bookings:

2.1 Confirmation of studio booking by the client: A booking is confirmed when the Epi Studios “Booking Confirmation” is sent by the Epi Studios.

2.2 A standard day rate is 10 hours, a half day is 5 hours unless otherwise indicated or communicated. All sessions are inclusive of set up and pack down. If a session goes over the booked time, the client will pay by the hour.

2.3 We retain the right to issue the invoice for the full amount 7 days prior to the session  and payment must be received before the end of your booking via EFTPOS or credit card, unless you have made alternate plans in writing with the Studio.

Guest Passes

Epi Studios will provide clients with a guest pass for the duration of their booking that will allow them access to the studio. The client is responsible for returning this pass to the engineer or assistant engineer at the end of the session. If the client fails to return the pass, a replacement fee of $200 + GST will be added to the balance invoice for lost or stolen passes.

 

Cancellation or Postponement of Confirmed Studio Booking

Once a booking is confirmed, a 50% cancellation or postponement fee applies up to 48 hours prior to cancellation/postponement, or 100% if cancelled/postponed within 48 hours of the booking.

 

Charges

The artists, producers, and engineers attending studio sessions on the client’s behalf are deemed by Epi Studios to be duly authorized representatives of the client. It is the client’s responsibility to set limits on charges arising from or for sessions. Epi Studios is not liable for any costs or expenses incurred by the client’s representatives during the course of the studio sessions.

 

Cleaning and Damages

Epi Studios retains the right to charge the client cleaning and/or damage fees in the event of any damage to the studio, equipment, infrastructure, or facility, including but not limited to spills, water damage, mistreatment of equipment, and accidental damage. This charge also pertains to smoking of any kind, as it is prohibited throughout the entirety of the facility.

 

Occupational Health and Safety

Clients and their representatives located on Epi Studios premises must comply with Epi Studios’ occupational health and safety guidelines. Epi Studios reserves the right to refuse the use of any client or client representative’s equipment (including software) on the premises if, in Epi Studios’ opinion, such equipment exposes Epi Studios’ property to a risk of loss or damage, is unsafe or breaches occupational health and safety laws, including failure to comply with Electrical Safety Standards AS/NZS 3760:2003.

  

Working on Site / Restrictions on Attending Studio Sessions

If you have a suspected or confirmed case of COVID-19, you are not permitted to attend the site and need to isolate yourself immediately to prevent it from spreading to other people. This extends to Epi Studios staff/team members and all Epi Studios clients. Similarly, you are not permitted to attend the studios and must self-isolate if you exhibit the following:

  • If a family member or household member is diagnosed with COVID-19

  • If you are showing any flu-like symptoms

Epi Studios reserves the right to refuse any staff member or client who does not comply with the above.

 

Payments and Refunds

 

Goods and Service Tax

All prices quoted are exclusive of Goods and Services Tax unless otherwise stated. Prices are subject to the addition of Goods and Services Tax and any other tax or charge imposed by any government agency on goods or services quoted or on production, sale, distribution, delivery, or on any feature of such goods and services if applicable. All such taxes are payable by the client and will be added to the price by Epi Studios.

 

Payment Terms

Unless prior credit arrangements have been approved in writing by Epi Studios, payment in full is required before the completion of each studio booking. Remittance is accepted by all major credit cards. The client will be liable for any fees, costs, and expenses incurred by Epi Studios for any debt collection process. Where credit terms have been agreed, payment is strictly 14 days from the date of invoice.

 

Refund Policy

Unless there is a technical fault with the recordings or masters provided, Epi Studios does not offer refunds.

Intellectual Property

Any intellectual property rights in relation to the audio services provided to the client shall remain the property of Epi Studios unless otherwise agreed in writing. The client agrees that Epi Studios may use recordings, photographs, or videos taken during the session for promotional purposes unless otherwise advised in writing by the client.

 

Confidentiality

All client material and any personal information given to Epi Studios will be treated as confidential and will not be disclosed to any third party except as required by law, or as agreed in writing by the client.

 

Liability and Indemnity

The client agrees to indemnify and hold harmless Epi Studios and its employees, agents, directors, and shareholders against any loss, claim, damage, or liability arising from any act, omission, or default of the client, its employees, agents, directors, or shareholders, in relation to any audio services provided by Epi Studios. In no event shall Epi Studios be liable for any indirect or consequential loss or damage arising from any act, omission, or default of Epi Studios.

 

Termination

Epi Studios may terminate any booking or this agreement immediately if the client breaches any of the terms and conditions contained herein. Upon termination, Epi Studios may retain any deposit paid by the client and may claim any additional costs or expenses incurred as a result of the client’s breach.

 

Governing Law

This agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia, and the parties hereby submit to the non-exclusive jurisdiction of the courts of New South Wales.

 

Entire Agreement

These terms and conditions constitute the entire agreement between Epi Studios and the client, and supersede all prior agreements, negotiations, and understandings, whether written or oral, relating to the subject matter herein.

 

Amendments

Epi Studios may amend these terms and conditions at any time by providing written notice to the client. The client’s continued use of Epi Studios’ services after receiving such notice shall constitute acceptance of the amended terms and conditions.

 

Waiver

Any failure or delay by Epi Studios to exercise any right or remedy under this agreement shall not operate as a waiver thereof, nor shall any single or partial exercise of any right or remedy preclude any other or further exercise thereof or the exercise of any other right or remedy.

 

Assignment

 The client may not assign, transfer, or sub-license any of its rights or obligations under this agreement without the prior written consent of Epi Studios. Epi Studios may assign or transfer any of its rights or obligations under this agreement at any time without notice to the client.

 

Severability

If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
